Terms of Service

3.1 What's Included

• Professional website design and development
• Website hosting on our infrastructure
• SSL certificate
• Regular backups
• Security updates and maintenance
• Content updates as per your plan
• Email support (24-48 hour response time)
• SEO optimization (on-page only)

3.2 What's NOT Included

We explicitly do NOT provide:

• E-commerce functionality (shopping carts, payment gateways)
• Booking or scheduling systems
• Custom web applications
• Member areas or user login systems
• Complex forms or databases
• Third-party integrations (beyond basic embeds)
• Logo design or branding services
• Content writing or copywriting
• Photography or video production
• Social media management
• Paid advertising or SEO campaigns

4.1 Minimum Commitment

All plans require a 6-month minimum commitment. This allows us to recoup the cost of building your website for free. After 6 months, your subscription continues on a month-to-month basis.

4.2 Payment Terms

• Subscription fees are billed monthly in advance
• Payments are processed through Stripe
• First payment is due before we begin building your website
• All prices are in Australian Dollars (AUD) and include GST
• Failed payments may result in service suspension

4.3 No Setup Fees

We build your website completely free - no upfront costs, no setup fees. You only pay the monthly subscription.

5.1 Cancellation After 6 Months

After completing the 6-month minimum commitment, you may cancel at any time with 30 days' written notice. Your website will remain live during the 30-day notice period.

5.2 Early Termination

If you cancel before completing 6 months, a 50% early termination fee applies to the remaining balance. For example, if you cancel after 3 months on the Basic plan ($49/month), you would owe: 3 months remaining × $49 × 50% = $73.50

This fee compensates us for the free website build and initial setup work we performed at no upfront cost to you.

5.3 Alternative: Purchase Source Code

Instead of paying early termination fees, you may purchase the full source code for your website for a one-time fee of $800. You'll then have 30 days to migrate to your own hosting.

7.1 Your Content

You retain full ownership of all content you provide (text, images, logos, videos). By providing content, you grant us a license to use it for building and hosting your website.

7.2 Website Code and Design

While subscribed, you are licensing the website design and code from us. We retain ownership. Upon cancellation:

• We take down your website
• You may purchase the source code for $800 to retain ownership
• You keep all your original content

7.3 Domain Names

• If you provide your own domain, you retain full ownership
• If we register a domain for you, we own it during your subscription to maintain control of the hosting environment
• Upon cancellation (after 6 months), we transfer the domain to you at cost

9.1 Hosting Control

We control where and how your website is hosted. This is non-negotiable and ensures we can maintain quality, security, and uptime.

9.2 Uptime Guarantee

We strive for 99.9% uptime but do not provide an SLA guarantee. Scheduled maintenance will be communicated in advance when possible.

9.3 Backups

We perform regular automated backups. However, you are responsible for maintaining your own backups of any critical content.

9.4 Data Security

While we implement industry-standard security measures, we cannot guarantee complete security. You are responsible for the security of any credentials we provide.

15.1 Governing Law

These Terms are governed by the laws of Queensland, Australia.

15.2 Informal Resolution

Before pursuing formal legal action, you agree to contact us to attempt to resolve the dispute informally. Most disputes can be resolved through good-faith negotiation.

15.3 Small Business and Consumer Disputes

For disputes under $25,000, you may seek resolution through your state's small claims tribunal.
